Rebar.Shop Inc. - Terms and Conditions


• Below mentioned terms and conditions will be applicable to all the estimates/invoices made for rebar supply only by Rebar.shop and any acceptance of the estimate/invoice is expressly limited to the below mentioned terms and conditions.


Payment And Pricing:

- The invoice/estimate is a unit price contract i.e. based on weight of rebars/number of pieces supplied with payment due upon receipt of the Invoice.

- This is a supply only estimate/invoice and is not subject to any holdback.

- Should any or all payments not be made promptly at the time, or they respectively become due, Rebar.shop may, without prejudice to its rights, stop or delay further work or shipments, and at its options, all or any portion of the overall rebar supply from the quotation/estimate or final invoice.

- Customer should verify the dimensions and quantities mentioned in the estimate/invoice before making payment.

- All estimates will be valid for 30 days after the creation date mentioned on the estimate, unless a different validity date is specified on the estimate.

- All Prices are subject to change, Rebar.shop reserves the right to make any changes in the prices


Additions/Changes/Shortages in Rebars/Fabrication:


-Any addition in rebars will be charged according to unit prices mentioned in estimate/original invoice if additions/changes are done before starting fabrication.

-If there are any addition/changes in the rebars after fabrication is started, the customer is liable to pay the extra amount over and above to unit prices from the original invoice/estimate.

-Claims for shortage of material must be made in writing within 48 hours of delivery and supported by the bill of lading/packing slips and such additional evidence as may be deemed necessary by Rebar.shop.


Addition in rebars weight after Shop Drawings:

-If there is any change in the weight/number of rebars after shop drawings are made, the customer is charged for the additional rebars according to unit prices mentioned in estimate/original invoice.


Shop Drawings:

-All shop drawings must be approved and stamped by the designated official structural engineer.

-Fabrication will be done only after receiving stamped approval from the designated official structural engineer.

-Bars, Mesh and accessories will be estimated and detailed according to latest edition of R.S.I.C. Manual of Standard Practice

-Upon completion of shop drawings, only one revision will be done without any additional charges, any extra revisions after that will be charged at $55 per hour.


Transportation and Offloading: 

- All estimates and invoices are for rebar pick-up only from our workshop at 9 Cedar Avenue, Thornhill unless transportation to the project site is specified in the estimate/invoice including delivery site address and charges.

- Clients/Customers are responsible for offloading rebars at project site as we don’t provide the unloading equipment unless asked for it by customer in advance and is applicable with additional charges.

- Clients/Customers who have not opted for the delivery with unloading equipment should provide adequate size machinery & operator.

- If a client/customer is not able to provide machinery for unloading and is going to unload the material manually by hand, he should notify the same in advance to the concerned salesperson to plan the delivery accordingly.

- The client/customer is responsible for giving clear access to the construction site without compromising any safety standards.

- Waiting charges of $5/minute will be applicable if unloading is not started by customer after 30 min of reaching project site.  

- Any delays to delivery/unloading due to unforeseen circumstances like extreme weather, traffic conditions, road closures, etc. should be acceptable for both parties.

- Client/Customer shall schedule all deliveries a minimum of 3 working days in advance. Costs incurred by Rebar.shop due to cancellation or re-scheduling will be the responsibility of the client/customer.

Delays in supply:

-  Rebar.shop. is not liable for any delays caused by labor disputes. Accidents, fire, truck, rail, air or water transportation, acts of God or other acts beyond its control.

Quality of the material:

-   If requested, Rebar.shop shall supply Mill Test Reports on all material being supplied to the project by Rebar.shop but is not held responsible for any costs incurred on material removed from the site for testing purposes.

-  Pouring of concrete over reinforcement constitutes acceptance of the reinforcement as supplied/detailed.

- The liability of Rebar.shop for any rebars which are defective for any reason shall be limited to the repair or replacement of these bars, or at the option of Rebar.shop, to the selling price of these bars. Rebar.shop shall not be liable for consequential damages. Rebar.shop must be advised within 72 hours before any action is taken by any claimant for defective material, and such material shall be held for inspection by Rebar.shop.

 Returns & Restocking Charges:

- Once Fabrication is done, no returns are accepted.

Other Terms and Conditions:

- No one has the authority to depart from conditions hereof or to make any representations or warranties not herein contained.

- Rebar.shop shall not be liable for any back charges.

Disputes

- Any dispute, controversy, or claim arising out of or relating to this agreement, including its formation, interpretation, performance, or breach, shall be settled by arbitration administered by the Arbitral Tribunal in accordance with Commercial Arbitration Act. The arbitration shall take place in Toronto or Greater Toronto Area, Ontario and the arbitrator's decision shall be final and binding. Each party shall bear its own costs associated with the arbitration, except that the prevailing party may recover its reasonable attorneys' fees and costs. This agreement shall be governed by the laws of the State of Ontario, without regard to its conflict of law principles.
